These Terms & Conditions (“Terms”) govern your access to and use of the nutrition, wellness, fitness, and related services provided by swiftsoma through swiftsoma.com, its representatives, professionals, digital platforms, and other authorised channels.
By purchasing, enrolling in, accessing, or participating in any swiftsoma programme or service, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree with any part of these Terms, please do not purchase or use our services.
1. Nature of Our Services
swiftsoma provides personalised nutrition, wellness, lifestyle, and related fitness-support services designed to assist clients in working towards their individual health and wellness goals.
Our recommendations are developed using relevant nutritional principles, professional knowledge, and the information provided by the client. However, individual outcomes can differ considerably depending on factors such as age, lifestyle, adherence, existing health conditions, medications, genetics, and individual physiological responses.
swiftsoma does not guarantee any specific result, including a particular amount of weight loss, weight gain, muscle gain, fat loss, or any other health or fitness outcome.
Unless specifically stated otherwise by a suitably qualified professional, information provided through our services should not be considered a substitute for medical diagnosis, treatment, or emergency healthcare.
2. Health Information, Client Responsibility & Safety
Clients are responsible for providing swiftsoma with complete, accurate, and up-to-date information relevant to their participation in our services.
This may include information relating to:
- Existing or previous health conditions
- Allergies and food sensitivities
- Medications and supplements
- Medical history
- Dietary preferences or restrictions
- Pregnancy or other relevant circumstances
- Laboratory reports or other information requested by the professional
Clients should promptly inform swiftsoma of any material change in their health or circumstances during the programme.
swiftsoma shall not be responsible for consequences arising from inaccurate, incomplete, outdated, or intentionally withheld information provided by a client, or from failure to follow professional recommendations appropriately.
Where a client’s circumstances require medical attention or specialised healthcare, swiftsoma may recommend consultation with an appropriately qualified medical or healthcare professional.
3. Payments, Fees & Pricing
- Programme and consultation fees must be paid according to the payment terms communicated at the time of purchase.
- Unless expressly stated otherwise, fees are payable in advance.
- Fees paid for a programme or service are non-transferable and non-refundable, except where a refund is specifically required under applicable law or expressly provided under our refund policy.
- swiftsoma reserves the right to revise its fees and pricing from time to time.
- Any price change will apply to future purchases and will not ordinarily affect programmes that have already been paid for, unless otherwise required by applicable law.
- International clients may be charged according to the applicable pricing or currency rate communicated by swiftsoma at the time of purchase.
- Any applicable taxes, transaction charges, currency-conversion charges, or payment-processing fees may be payable by the client where applicable.
4. Client Conduct & Communication
swiftsoma is committed to maintaining a professional, respectful, and safe environment for both clients and team members.
Clients are expected to communicate respectfully with dietitians, trainers, consultants, support staff, and other representatives of swiftsoma.
Any abusive, threatening, discriminatory, harassing, inappropriate, fraudulent, or otherwise unacceptable behaviour may result in suspension or termination of services.
Where services are terminated because of serious misconduct or a material breach of these Terms, the client may not be entitled to a refund, subject to applicable law.
swiftsoma may retain or review relevant communications where reasonably necessary for customer support, service quality, safety, dispute resolution, or compliance with applicable policies and law.
5. Consultations, Appointments & Follow-Ups
- Consultations and follow-up sessions are scheduled according to professional and operational availability.
- Clients are expected to attend scheduled appointments on time.
- Follow-up consultations may be conducted by members of the swiftsoma nutrition or wellness team, with appropriate senior-level review where applicable.
- Where a programme includes periodic senior, specialist, or departmental review, such review will be conducted according to the programme structure communicated at the time of enrolment.
- If a client misses a scheduled consultation because of personal unavailability, the session may be considered utilised and may not be rescheduled unless otherwise approved by swiftsoma.
- If a scheduled session is cancelled or missed because of swiftsoma, reasonable alternative arrangements, rescheduling, or an appropriate extension may be provided, subject to availability.
- Clients are responsible for ensuring that they are available at the agreed appointment time and have access to the required communication platform or technology.
6. Service Availability & Operating Hours
swiftsoma’s standard operating hours are:
Monday to Saturday: 10:00 AM to 7:00 PM IST
Services may be unavailable on public holidays or during periods communicated by swiftsoma.
For international clients, appointments may be arranged in advance based on reasonable time-zone flexibility and professional availability.
Occasional service interruptions may occur because of technical issues, holidays, staff availability, unforeseen circumstances, or other operational reasons. Where reasonably possible, swiftsoma will make suitable alternative arrangements.
7. Plan Hold / Freeze Policy
A client may request a temporary hold or freeze of an active programme for genuine and reasonable circumstances.
Any hold request is subject to prior approval by swiftsoma and may require supporting documentation where appropriate.
The maximum permitted hold period is generally as follows:
| Programme Duration | Maximum Hold Period |
|---|---|
| 1 Month | 1 Week |
| 3 Months | 2 Weeks |
| 6 Months | 3 Weeks |
| 12 Months | 5 Weeks |
Once the approved hold period ends, the programme will automatically resume.
A hold cannot be used to permanently extend the programme or carry unused sessions beyond the approved programme period unless expressly authorised by swiftsoma.
8. Programme Duration & Expiry
All swiftsoma programmes are valid for the duration specified at the time of purchase.
Clients are expected to actively participate in the programme during its validity period.
Any unused consultations, sessions, services, or programme benefits will ordinarily expire upon completion of the programme period and will not automatically be:
- Carried forward;
- Converted into cash or credit;
- Transferred to another person; or
- Extended beyond the original programme period.
An extension may be granted only where expressly approved by swiftsoma, including where an extension is appropriate because of circumstances attributable to swiftsoma.
Extended periods of inactivity or non-engagement may result in closure of the programme without entitlement to a refund.
9. Cancellation & Termination
swiftsoma may suspend or terminate a client’s access to services where there is:
- A material breach of these Terms;
- Repeated inappropriate or abusive behaviour;
- Misuse of swiftsoma’s services or materials;
- Fraudulent or misleading information;
- Unauthorised sharing or reproduction of programme materials; or
- Any other circumstance that reasonably prevents swiftsoma from continuing the service.
A client may discontinue participation at any time. However, discontinuation by the client does not automatically create an entitlement to a refund.
Any refund, cancellation, or adjustment will be handled in accordance with the applicable refund policy and applicable law.
10. Intellectual Property & Use of Materials
All nutrition plans, diet charts, educational materials, documents, photographs, videos, graphics, written content, programme structures, methodologies, website content, branding, logos, and other materials provided by swiftsoma remain the property of swiftsoma or its respective licensors, where applicable.
Materials supplied to a client are intended solely for the client’s personal use.
Clients may not, without prior written permission from swiftsoma:
- Copy or reproduce programme materials;
- Share or distribute plans with third parties;
- Sell, publish, license, or commercially exploit the materials;
- Upload the materials to public platforms;
- Modify and redistribute the materials; or
- Use swiftsoma’s proprietary content for commercial purposes.
Unauthorised use or distribution may result in termination of services and may lead to further action where permitted by law.
11. Results & Limitation of Liability
swiftsoma makes no representation or guarantee that a client will achieve a particular health, nutrition, body-composition, weight, fitness, or wellness outcome.
Results are individual and may depend on numerous factors outside swiftsoma’s control, including adherence, lifestyle, medical history, genetics, medication, sleep, stress, physical activity, and other physiological factors.
To the extent permitted by applicable law, swiftsoma shall not be responsible for indirect, incidental, special, consequential, or unforeseeable losses arising from the use of its services.
Where liability is legally established against swiftsoma, the extent of such liability shall, to the extent permitted by applicable law, be limited to the amount actually paid by the client for the specific service giving rise to the claim.
Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.
12. Privacy & Personal Information
swiftsoma may collect information necessary to provide and manage its services, including contact details, programme information, dietary information, and other information voluntarily provided by the client.
Such information will be handled in accordance with swiftsoma’s applicable Privacy Policy and applicable data-protection and privacy laws.
Clients are responsible for ensuring that information submitted to swiftsoma is accurate and up to date.
13. Changes to These Terms
swiftsoma may revise or update these Terms from time to time to reflect changes in its services, business practices, applicable laws, or operational requirements.
The updated version will be published on swiftsoma.com with the applicable revision or effective date.
Where legally permitted, continued use of the services after the revised Terms become effective will constitute acceptance of the updated Terms.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and interpreted in accordance with the laws applicable in India.
Any dispute arising from or relating to these Terms or the services provided by swiftsoma shall first be addressed through good-faith discussions between the client and swiftsoma.
Where the dispute cannot be resolved amicably, it shall be subject to the jurisdiction of the competent courts at Muzaffarpur, Bihar, unless otherwise required by applicable law or mutually agreed by the parties to be resolved through arbitration.
Nothing in this clause prevents a consumer from exercising any mandatory rights or remedies available under applicable consumer-protection law.
15. Acceptance of Terms
By purchasing a programme, booking a consultation, submitting an enrolment form, making payment, or otherwise using swiftsoma’s services, you confirm that you have read and understood these Terms & Conditions and agree to be bound by them.
If you do not agree with these Terms, you should not purchase or continue using the applicable swiftsoma services.
